DirecTV alleges that defendants Borow and Doe have assisted others in pirating DirecTV’s signal and have pirated DirecTV’s signal themselves. DirecTV accuses defendants of violating the Digital Millenium Copyright Act, The Communications Act, and the Federal Wiretap Act. “On information and belief,” DirecTV believes Borow is the primary owner of the AOL account “ump25@aol.com,” which DirecTV alleges has been used to post over a thousand messages on various internet forums instructing other individuals in obtaining DirecTV programming without authorization or payment. This account name is also associated with a Paypal account allegedly used to buy and sell equipment used in obtaining DirecTV programming. DirecTV accuses unidentified defendant John Doe—whom DirecTV says is a major league baseball umpire and DirecTV hacker—of acting in concert with Borow by using the screen name “Ump25” to answer questions about baseball and about stealing DirecTV.
